HEALTH SERVICE EXECUTIVE  Welcomes fourth Waterford Prosecution regarding smoking in the workplace legislation

The Health Service Executive, South Eastern Area (HSE SE), has welcomed the prosecution of a premises in Kilmacthomas, Co. Waterford in relation to a breach of the law banning smoking in the workplace. 

At a sitting of Kilmacthomas District Court on Wednesday May 18th, Mr. Louis Dunne (person in charge) pleaded guilty to a summons of permitting smoking at 'Carroll's Cross Inn', Carroll's Cross, Kilmacthomas, Co. Waterford on 13th November 2004 last.  

At the District Court hearing of the case, the solicitor representing the HSE SE summarised a history of complaints, warning letters and subsequent undercover inspections. Mr. Dunne was convicted, fined €400 and expenses of  €693. Costs of €1,314.50 were awarded to the HSE SE. 

Mr. Ray Parle (Principal Environmental Health Officer, Waterford Community Services) said that the overall level of compliance to the legislation was positive, however it is essential that the message goes out that the law on smoking in the workplace is being enforced against non-compliant businesses. This is the HSE SE’s 4th successful prosecution in the Waterford Community Services area since the introduction of this legislation.
